OVERVIEW
Welcome to Modern Retreat. These Terms of Service (“Terms”) govern your access to and use of modernretreatbuildings.com and the products, information, quote requests, project services, financing resources, and related services offered by Modern Retreat (“Services”).
By visiting our website, submitting a quote request, communicating with us regarding a project, or purchasing a product from us, you agree to these Terms.
If you do not agree to these Terms, you should not use the Services.
Modern Retreat operates an online showroom for premium building solutions, including pre-cut Signature Home building packages, coordinated property packages, backyard office solutions, wellness structures, and related third-party products and services.
Certain products displayed on our website are quote-based, customized, made to order, supplier-produced, engineered, or otherwise require project-specific review before an order can be finalized.
1. WEBSITE INFORMATION AND PRODUCT DISPLAY
We make reasonable efforts to provide accurate product descriptions, specifications, dimensions, square footage, images, renderings, pricing, availability, estimated timelines, and other information.
However, product information may be updated, corrected, or changed at any time before a final order is accepted.
Photographs, renderings, floor plans, diagrams, videos, staged images, and other visual materials are for illustrative purposes.
Images may show optional upgrades, furnishings, appliances, landscaping, foundations, decks, patios, driveways, site improvements, finishes, accessories, lighting, cabinetry, flooring, garage doors, or other items that are not included in the standard building package.
Final product specifications and inclusions are determined by the written quote, proposal, order agreement, invoice, specifications, drawings, or other project documents accepted by the customer.
2. STARTING PRICES AND QUOTE REQUESTS
Prices identified as “Starting at,” base pricing, estimated pricing, or similar language are preliminary and do not constitute a final project price or binding offer.
A displayed starting price generally represents the applicable building package or base product configuration and should not be interpreted as the total cost of a completed construction project.

Customization
Supplier pricing
Engineering requirements
Delivery location
Freight
Container requirements
Unloading requirements
Site access
Taxes
Permits
Professional services
Installation arrangements
Local code requirements
Other project-specific factors
Submitting a Request a Quote, Start a Project, financing inquiry, contact form, or similar request does not create a purchase contract and does not obligate either the customer or Modern Retreat to complete a transaction.
A sale becomes binding only when the applicable written quote, order agreement, invoice, deposit requirement, or other transaction document has been accepted as required.
3. SIGNATURE HOME CLASSIFICATION
Modern Retreat Signature Homes are premium pre-cut and/or interlocking home building packages intended for assembly and construction at the customer’s project site.
Modern Retreat Signature Homes are not sold as completed HUD-code manufactured homes, mobile homes, or completed modular homes.
They are supplied as building packages containing pre-cut structural components, materials, and other items identified in the applicable product description, specifications, and final written project quote.
Use of broad industry or marketing terminology such as “prefab,” “home kit,” or similar terms in educational content does not change the actual classification or scope of a Modern Retreat Signature Home building package.
The final written project documentation controls the scope of each order.
4. BUILDING PACKAGE SCOPE
Unless expressly stated otherwise in writing, Modern Retreat building products should not be assumed to be turnkey completed homes or completed construction projects.
Depending on the product, a building package may include:
Pre-cut structural components
Wall systems
Roof components
Doors
Windows
Hardware
Structural materials
Drawings
Engineering documents
Other items specifically identified for the applicable model
Unless specifically included in the customer’s final written quote, the following are not included:
Site preparation
Land clearing
Excavation
Grading
Foundations
Concrete work
Utilities
Plumbing
Electrical systems
HVAC
Septic systems
Wells
Interior finishes
Cabinetry
Appliances
Floor coverings
Painting
Assembly labor
Installation labor
General contracting
Cranes
Forklifts
Telehandlers
Unloading equipment
Landscaping
Driveways
Permits
Inspections
Impact fees
Utility fees
Local professional services
Other site-specific construction work
5. CUSTOMER RESPONSIBILITY FOR SITE, ZONING, AND PERMITS
Building codes, zoning requirements, setbacks, HOA rules, land-use regulations, permit requirements, energy requirements, foundation requirements, utility requirements, wildfire requirements, wind requirements, snow-load requirements, seismic requirements, occupancy requirements, and other regulations vary by jurisdiction and property.
The customer is responsible for determining whether a product is suitable and permitted for the customer’s property before proceeding with a purchase, unless Modern Retreat expressly agrees in writing to perform a particular service.
Customers should consult their local building department, planning department, fire authority, licensed contractor, engineer, architect, or other qualified professional as appropriate.
Modern Retreat does not guarantee that a particular building or project will be approved for any specific property, jurisdiction, occupancy classification, rental use, commercial use, residential use, or other intended purpose.
6. ENGINEERING AND CONSTRUCTION DOCUMENTS
Certain Signature Home building packages include stamped structural engineering when identified in the applicable product description, specifications, or final written project quote.
Stamped structural engineering should not automatically be interpreted as a complete permit-ready construction document package for every jurisdiction or property.
Full permit-ready construction drawing sets may be available as an additional paid project option when specifically offered and identified in writing.
Depending on the property and local jurisdiction, additional documents or professional services may be required, including:
Site-specific foundation engineering
Civil engineering
Grading plans
Drainage plans
Surveying
Architectural services
Energy-compliance documentation
Electrical plans
Plumbing plans
Mechanical plans
Fire-safety documentation
Wildfire-zone requirements
Septic design
Well documentation
Utility plans
Soils reports
Geotechnical reports
Local engineering revisions
Other jurisdiction-specific documentation
Local authorities may require revisions, supplemental engineering, or additional documentation based on site conditions and local code requirements.
7. ORDERS, DEPOSITS, AND PAYMENT
Payment schedules vary depending on the product and project.
Any deposit amount, progress payment, final payment, payment deadline, or other payment requirement applicable to a project will be disclosed in the written quote, invoice, order agreement, or related transaction documents before the order is finalized.
Modern Retreat may delay procurement, engineering, production, shipment, or other project activity until required payments and requested information have been received.
Unless otherwise stated in writing, a quote is subject to availability, supplier pricing, freight pricing, and other project-specific conditions in effect when the order is accepted.
8. PROJECT CHANGES
Customer-requested changes after a project has been quoted or ordered may affect pricing, engineering, production schedules, freight, delivery timing, materials, and other project requirements.
A requested change does not become part of the project until it is approved and confirmed in writing by Modern Retreat.
Some changes may not be possible after engineering, procurement, customization, production, or shipping has begun.
9. CANCELLATIONS, RETURNS, AND REFUNDS
Quote-based, customized, engineered, project-specific, made-to-order, or supplier-produced building packages may be subject to different cancellation and refund conditions than ordinary retail merchandise.
Cancellation, modification, return, deposit, and refund rights for a project are governed by:

Applicable law
Because supplier commitments, engineering, customization, procurement, production, or freight arrangements may begin after an order is accepted, customers should not assume that a standard retail return period applies to a building project.
Any non-refundable deposit, cancellation charge, restocking charge, supplier charge, or other project-specific restriction will be disclosed when applicable before the relevant order is finalized.
10. SHIPPING, FREIGHT, AND DELIVERY
Delivery dates and production timelines are estimates unless expressly guaranteed in writing.
Actual timing may be affected by:
Supplier production schedules
Material availability
Engineering revisions
Freight availability
Weather
Customs
Port activity
Carrier delays
Road conditions
Site accessibility
Permitting
Customer-requested changes
Force-majeure events
Other circumstances outside Modern Retreat’s reasonable control
Freight costs may depend on:
Delivery location
Shipment size
Shipment weight
Container requirements
Carrier requirements
Special equipment
Limited-access conditions
Residential delivery
Appointment requirements
Storage
Redelivery
Unloading
Crane service
Other accessorial services
Unless specifically included in writing, the customer is responsible for arranging suitable access to the delivery location and any equipment or labor required to unload the shipment.
Customers should inspect shipments promptly upon arrival.
Visible loss or damage should be noted on the carrier’s delivery documentation whenever reasonably possible.
Concealed damage or shortages should be reported promptly with photographs and supporting documentation.

11. DELIVERY SITE REQUIREMENTS
The customer is responsible for providing an accurate delivery address and safe, lawful, and adequate access for the required truck, trailer, container, carrier, or delivery equipment.
Customers should notify Modern Retreat before finalizing an order if the property has:
Narrow roads
Steep grades
Limited turning space
Weight-restricted roads or bridges
Gated access
Remote access
HOA delivery restrictions
Limited-access conditions
Other circumstances that may affect delivery
Additional charges resulting from undisclosed access conditions may be the customer’s responsibility to the extent permitted by applicable law and the applicable project documents.
12. INSTALLATION AND THIRD-PARTY CONTRACTORS
Unless expressly included in writing, Modern Retreat does not provide:
General contracting
Site preparation
Foundation construction
Assembly labor
Plumbing
Electrical work
HVAC installation
Utility connections
Other local construction services
Modern Retreat may provide information regarding independent installers, contractors, engineers, architects, financing providers, or other third parties.
Unless expressly stated otherwise in writing, those parties are independent businesses and are not employees or agents of Modern Retreat.
Customers are responsible for evaluating and contracting with third-party service providers.
Modern Retreat does not control the workmanship, licensing, insurance, schedules, pricing, warranties, professional judgment, or performance of independent contractors or other third-party providers.
13. FINANCING
Financing options displayed or linked on the website may be provided by independent third-party lenders or financing platforms.
Modern Retreat is not the lender unless expressly stated otherwise.
Financing eligibility, approval, interest rates, loan amounts, payment amounts, fees, terms, disclosures, credit decisions, and funding are determined by the applicable financing provider.
Checking financing eligibility, submitting a financing application, or obtaining financing approval does not constitute an order with Modern Retreat.
Financing approval also does not guarantee that the financing amount will cover the total cost of a customer’s completed construction project.
14. TAXES AND GOVERNMENT FEES
Customers are responsible for applicable sales, use, property, permit, inspection, impact, utility, or other taxes and government fees unless those charges are specifically included in writing.
Modern Retreat may collect taxes when required by applicable law.
15. WARRANTIES
Certain products may include written warranties provided by the applicable supplier, manufacturer, or other third party.
Warranty coverage, duration, exclusions, claim procedures, and remedies are governed by the applicable written warranty.
Modern Retreat does not create, expand, or modify a supplier or manufacturer warranty beyond its written terms unless expressly agreed in writing.
Site work, installation labor, contractor workmanship, locally supplied materials, and third-party services may be subject to separate warranties provided by the applicable contractor or provider.
16. PRODUCT AVAILABILITY
Products, models, specifications, options, upgrades, materials, supplier pricing, and availability may change.
Modern Retreat reserves the right to discontinue a product, modify available configurations, or substitute equivalent materials when permitted by the applicable project documents and law.
No product is guaranteed to remain available until the customer’s applicable order is accepted.
17. THIRD-PARTY SERVICES AND LINKS
The Services may contain links to or integrations with third-party websites, financing providers, suppliers, manufacturers, contractors, software services, or other businesses.
Modern Retreat is not responsible for the content, privacy practices, terms, availability, or performance of third-party websites or services.
Use of third-party services may be governed by separate terms between the customer and the third party.
18. INTELLECTUAL PROPERTY
The Modern Retreat name, branding, website design, original written content, graphics, logos, and other proprietary materials are owned by Modern Retreat or used under license or authorization.
You may not reproduce, distribute, commercially exploit, modify, scrape, republish, or use our proprietary materials without permission except as permitted by law.
Certain photographs, plans, specifications, product materials, and other content may be owned by or licensed from suppliers, manufacturers, designers, or other third parties and remain subject to their respective rights.
19. ACCEPTABLE USE
You may not use the Services for unlawful, fraudulent, abusive, deceptive, malicious, or unauthorized purposes.
You may not attempt to interfere with the security, operation, functionality, servers, networks, or data associated with the Services.
20. ERRORS AND CORRECTIONS
Occasionally information on the website may contain typographical errors, inaccuracies, omissions, incorrect pricing, outdated specifications, incorrect dimensions, or availability errors.
Modern Retreat reserves the right to correct errors, update information, withdraw products or offers, or cancel an affected transaction when permitted by law.
If a material error affects an accepted order, Modern Retreat will communicate with the customer regarding available options.
21. CUSTOMER DUE DILIGENCE
Before purchasing a building package, customers should independently evaluate:

Permitting
Site conditions
Foundation requirements
Utility requirements
Contractor availability
Local building codes
Project budget
Financing
Total anticipated construction costs
Modern Retreat encourages customers to obtain appropriate professional advice before making substantial project commitments.
22. NO PROFESSIONAL ADVICE
Information on the Modern Retreat website is intended for general informational and project-planning purposes.
Website information is not a substitute for professional:

To the extent permitted by law, the website and informational portions of the Services are provided on an “as available” basis.
Modern Retreat does not guarantee that website content will always be complete, current, uninterrupted, or error-free.
Nothing in these Terms excludes rights, warranties, disclosures, or remedies that cannot legally be excluded under applicable law.
24. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, Modern Retreat will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from use of the website or Services.
Nothing in these Terms limits liability where such limitation is prohibited by law.
Project-specific obligations and remedies may also be addressed in an applicable written quote, order agreement, warranty, or other transaction document.
25. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify and hold harmless Modern Retreat from third-party claims, damages, liabilities, losses, and reasonable expenses arising from:
Your unlawful use of the Services
Your violation of these Terms
Your infringement of another party’s rights
This provision does not apply where prohibited by applicable law.
26. PRIVACY
Personal information collected through the Services is handled in accordance with Modern Retreat’s Privacy Policy.
27. PROJECT-SPECIFIC DOCUMENTS CONTROL
For a specific project, the customer’s accepted written quote, proposal, invoice, specifications, drawings, order agreement, warranty documents, and other applicable project-specific documents control the agreed project scope.
If general website language or these Terms conflict with an accepted project-specific written agreement regarding that project, the project-specific written agreement controls to the extent permitted by applicable law.
28. GOVERNING LAW
These Terms are governed by the laws applicable to Modern Retreat’s principal place of business in California, without limiting mandatory consumer rights that may apply under other applicable law.
29. SEVERABILITY
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
30. ENTIRE AGREEMENT

constitute the applicable agreement regarding use of the Services and relevant transactions.
If a project-specific written agreement expressly conflicts with these general Terms regarding that project, the project-specific written agreement controls to the extent of that conflict.
31. CHANGES TO THESE TERMS
Modern Retreat may update these Terms from time to time.
The current version will be posted on the website with its updated effective date.
Changes will not retroactively alter an already accepted project agreement except where permitted by that agreement or required by law.
32. APPLICABLE RIGHTS
Nothing in these Terms is intended to waive, restrict, or eliminate consumer rights, warranties, remedies, disclosures, or other protections that cannot legally be waived or limited.
